La Corte europea di giustizia ha condannato il regime italiano di assegnazione delle frequenze radiotelevisive.

The European Court of Justice has issued a decision that obliges the Italian State to assign the radio-TV frequencies.

La Corte ha dato ragione a Europa 7, le cui frequenze sono occupate dalla rete di propaganda di Arcore, detta anche Rete 4.

The Court found in favour of Europa 7, whose frequencies are occupied by Arcore’s propaganda network, also called Rete 4.

- non rispetta il principio della libera prestazione dei servizi
|
- does not respect the principle of the free provision of services

- non ha criteri di selezione obiettivi - trasparenti - non discriminatori - proporzionati (poi ha finito gli aggettivi)

- does not have selection criteria that are objective, transparent, non-discrimating and proportionate (then it finished the adjectives)

La sentenza europea segue quelle a favore di Europa 7 della Corte costituzionale, del Consiglio di Stato e dell’Avvocato generale della Corte di Giustizia europea del 12 settembre 2007 (che ha bocciato la legge Gasparri).

The opinion of the European Court follows that in favour of Europa 7 by the Constitutional Court, by the Council of State and by the Advocate General of the European Court of Justice on 12 September 2007 (that overturned the Gasparri law).

Mi aspetto che si faccia applicare la sentenza senza invocare la Nato e l’ONU.

I expect that the law will be applied without having to go to the NATO or the United Nations.

Le frequenze radiotelevisive sono in concessione, significa che sono di proprietà dello Stato, che può decidere, liberamente, a chi assegnarle.

The radio-TV frequencies are a concession, which means they are the property of the State, which can decide, freely, to whom they are assigned.

Le frequenze sono quindi dei cittadini, di nostra proprietà.

The frequencies thus belong to the citizens, our property.
|

Le leggi che hanno regolamentato il sistema radiotelevisivo, dalla Mammì alla Gasparri, hanno creato un mostro: il Testo Unico.

The laws that have organised the radio-TV system, from the Mammì law to the Gasparri law, have created a monster: the Unified Text.

Cambiarlo solo in parte è inutile, va eliminato per poter definire, da zero, nuove regole che garantiscano una vera informazione.

To change it even partly, is useless. It should be eliminated so as to be able to start from nothing and define new rules that guarantee true information.

Sulle frequenze radiotelevisive farò una proposta per una nuova legge con l’aiuto di esperti del settore.
