Il Presidente del Consiglio ha detto pubblicamente che le intercettazioni dovevano essere limitate a fatti di mafia e terrorismo.

The Prime Minister stated publicly that telephone tapping must be restricted only to investigations revolving around Mafia activities and terrorism.

Poi nel progetto di Legge che è stato successivamente presentato, il bacino di utilizzabilità delle intercettazioni è stato allargato e tuttavia restano fuori reati di forte allarme sociale: l'associazione a delinquere, l'usura, il sequestro di persona, la rapina non aggravata, lo sfruttamento della prostituzione eccetera.

Then, in the draft Bill submitted subsequently, the utility pool for telephone tapping was expanded, leaving out certain crimes of serious social concern, such as criminal association, usury, kidnapping, common theft, exploitation of prostitution, etcetera.

Allora, è vero che quando si parla di intercettazioni c'è un problema che è quello di non utilizzare e meglio ancora non pubblicare, ciò che non ha a che fare con l'oggetto del processo con l'accertamento della verità, le conversazioni che riguardano terzi, cioè soggetti che col processo non centrano niente, e con conversazioni che pur riguardando soggetti del processo, toccano argomenti che non sono pertinenti al processo.

Now, it is true that there is a problem in principle with telephone tapping, which is that you cannot use, and even less so reveal any information that is not directly linked to the case in question, in other words getting to the truth, or relating to third parties that have nothing to do with the case, as well as with conversations that, although involving individuals that are involved in the case, nevertheless contain information that is not pertinent to the case itself.

Impedire l'utilizzazione nel processo e la pubblicazione fuori dal processo di conversazioni riferibili a terze persone di fatti non pertinenti, è secondo me un dovere imprescindibile e su questo versante quando il progetto di Legge fissa dei paletti, muove nella direzione giusta.

In my opinion, prohibiting the utilisation and the revelation of conversations involving third parties and regarding facts that are not pertinent is an inescapable duty and, in this regard, the draft Bill is moving in the right direction by establishing certain limits.

Questo progetto di Legge vieta la pubblicazione di tutte le intercettazioni, anche quelle pertinenti al processo, l'Articolo 2 di questo progetto di Legge dice:

This draft Bill prohibits the publication of all tapped telephone conversations, including those that are pertinent to the case. In this regard, Article 2 of the draft Bill states that:

"E' vietata la pubblicazione, anche parziale, per riassunto o nel contenuto di atti di indagine preliminare nonché di quanto acquisito, al fascicolo del pubblico ministero o del difensore, anche se non sussiste più alcun segreto fino a che non siano chiuse le indagini preliminari." Questo significa che si potrà pubblicare a malapena il nome dello indagato.

"It is prohibited to publish any information obtained, even partially, in summary or included in the content of the preliminary investigation documentation or in the prosecution or defence files, even where there are no existing grounds for maintaining confidentiality, until such time as the preliminary investigations have been concluded." What this means is that it would even be difficult to reveal the name of the individual under investigation.

C'è un altro profilo da prendere in considerazione ed è che le intercettazioni possano durare soltanto 3 mesi.

Another aspect to be taken into account is that telephone tapping operations will only be allowed to continue for 3 months.

Ora far durare le intercettazioni soltanto 3 mesi cioè in uno spazio di tempo che in moltissimi casi può essere insufficiente per dover interrompere sul più bello le intercettazioni, non è vietare le intercettazioni ma è svuotarle, depotenziarle, in maniera che per quanto riguarda l'incisività delle indagini può essere pericoloso.

Allowing telephone tapping for 3 months, in other words for a time period that in many cases will not be sufficient time, to then have to cease the tapping just when things are starting to happen, does not mean prohibiting the entire operation, but is tantamount to making it meaningless or to emasculate it in the sense that, as regards its impact on the investigations, such an action could be dangerous.
