Here is the text of my participation in the Otto e Mezzo programme on Thursday, 29 May, where I answer questions regarding the judiciary, put to me by Lanfranco Pace.

Antonio Di Pietro: You have asked me: "Don’t you think that insisting on the principle of legality is simply obstinacy?" No, I don’t think it is. Someone who stands on the principle of legality is not being obstinate, but simply stating a democratic principle.

Seconda cosa. Lei ha detto: "Ma è mai possibile che tutti i magistrati fanno bene e nessuno sbaglia?". Come no, sbagliano.

Secondly, You asked: "But is it possible that all magistrates are doing the right thing and that none of them ever make mistakes?" Anything but, of course they sometimes make mistakes.

Il problema è che nel nostro Paese, da un po di tempo, più che prendersela con quelli che sbagliano, se la prendono con quelli che non sbagliano e che invece fanno il loro dovere.

The problem is that in our Country, in recent times, instead of taking it out on those that make mistakes, they have been taking it out on those that don’t make mistakes, but that have been doing their job very well.

Facciamo una cosa, prenda una buona abitudine: vada a vedere tutte le punizioni che il Csm ha dato e sta dando ancora in questi ultimi tempi a magistrati che si ritiene non abbiano fatto il loro dovere.

Let’s try something, why don’t you make it a habit to go and review the sentences that the Csm has handed down, and continues to hand down in recent cases against judges that have apparently failed to do their jobs properly.

Secondo, ritengo che ci siano magistrati che sbagliano e che non fanno il loro dovere, ed è bene procedere nei confronti di questi.

L'anomalia italiana non sta in questo, ma sta nel fatto che da 10 anni a questa parte, da quando è scoppiata Tangentopoli, vengono criminalizzati coloro che fanno il loro dovere.

Vede, quando i magistrati di Milano hanno fatto determinate indagini nei confronti di persone vicine e legate al Presidente del Consiglio, tutta l'informazione pilotata e tutta la politica ha sempre attaccato i magistrati che facevano le indagini, non quelli che commettevano reati.

You see, when the Milan magistrates began with certain investigations involving people close to and associated with the Prime Minister, the full force of the controlled media has always been unleashed against the investigating magistrates, instead of against those involved in criminal activities.

Quello che sto cercando di far capire è che pensare di scaricare le colpe sul magistrato che indaga e non su colui che commette i reati è una delle più gravi anomalie del nostro Paese, soprattutto dovuta al fatto che un sistema d'informazione italiana, in mano ad un conflitto d'interessi palese, deforma la realtà, che fa passare per guerra fra bande quella che è una guerra tra guardia e ladri, aggravata dal fatto che qualche volta il ladro è pure il magistrato.

What I am trying to show is that attempting to lay the blame on the investigating magistrate instead of on the individual that commits the crime is one of the most serious problems of our Country. This is mainly due to the fact that the Italian media system is subject to a patent conflict of interests, to the point where it skews the reality, which passes of a battle between guards and thieves as being simply a battle between rival groups and is aggravated by the fact that, on occasion, the magistrate is also the thief.

Antonio Di Pietro: A Napoli dell'inchiesta si sa da tempo, tanto che da gennaio si sono chieste le misure cautelari.

Antonio Di Pietro: In Naples, they have been aware of this inquiry for some time, to the extent that precautionary measures were already asked for as far back as January.

Per fare una misura cautelare di 800 pagine, e leggere almeno un milione e mezzo di pagine, ci vogliono almeno 2 o 3 mesi.

L'anomalia non sta nel fatto che i magistrati di Napoli hanno proceduto oggi nel confronto di alcune persone per ipotesi di reato, ma che quelle persone, sapendo la situazione in cui si trovano, si mettono a fare un'attività istituzionale proprio per i fatti per cui sono sotto indagine.

The mistake is not that the Naples magistrates, specifically today, acted against certain people for alleged offences, but rather that those people, being perfectly aware of the situation they find themselves in, choose to proceed with the institutional activities concerning the very same matters for which they are being investigated.

L'anomalia quindi non sta nel magistrato che indaga, ma nel fatto che chi è sotto indagine invece di correre dal magistrato corre a mettersi in una posizione per diventare impunito. Abbia pazienza.

The error is not, therefore, the fact that the magistrate is busy investigating, but the fact that the person being investigated, instead of running to the magistrate, instead runs in an attempt to avoid prosecution. Come on!

Lanfranco Pace: L'anomalia secondo lei non è fare un ordinanza di rinvio a giudizio di 600 pagine e presentare un milione e mezzo di pagine in faldoni, cioè mille cinquecento faldoni da mille pagine che sono l'enciclopedia britannica moltiplicata mille. Le sembra un'idea di giustizia rapida e moderna? Non credo.

Lanfranco Pace: So, in your opinion, the mistake lies in not drafting a 600-page application for committal to trial, and then to submit one and a half million pages in dossiers, in other words one thousand five hundred dossiers, containing a thousand pages each, which, in terms of quantities, is equivalent to the Encyclopaedia Britannica times a thousand. Do you honestly believe that this makes for a speedy and modern justice system? I don’t think so.

Antonio Di Pietro: Non è cosi, mi spiace, nel senso che lei non può prendere un po di prove ed un po di fascicoli e buttarli via semplicemente per fare un fascicolo più corto. Abbia pazienza, ma che giustizia è?

Antonio Di Pietro: That is not true, I’m sorry, in the sense that you cannot take some proof and some dossiers and simply throw them away simply in order to have a smaller dossier. Come on! What kind of justice is that?

Antonio Di Pietro: The blame does not lie with the magistrates, but rather with those that commit the crimes that force us to compile many pages of statements.
|
