I am publishing here the video and the transcript of my speech in Parliament, of the response of the Under Secretary of State for Justice and my reply, in which I put forward for the attention of the government and for Parliament and for the country, that today there is in existence every means and every tool apart from physical violence and barbaric invasion to damage the independence or the unity of the State.

Si tratta di un tema che credo sia opportuno riprendere in considerazione, perché ritengo che nella scorsa legislatura, nel 2004, il disegno di legge (che, in realtà, fu approvato nel 2006, ma venne presentato già alla fine del 2004) molto sbrigativamente è diventato nuova legge dello Stato.

Non v'è dubbio che c'è e ci deve essere un grande dibattito in ordine a questo tema sul quale torneremo prossimamente, perché riteniamo che il Parlamento debba porre maggiore attenzione ai limiti entro i quali il diritto di opinione può esercitarsi, in spregio ad altri diritti fondamentali dell'individuo.

There is no doubt that there is and that there must be a big debate about this topic which we will come back to in the near future, because we believe that Parliament should place greater attention to the limits within which the right to an opinion can be expressed, to the detriment of other fundamental rights of the individual.

L'articolo 283 del codice penale non prevede un reato di opinione, né tanto meno è ascritto alla parte del codice penale che riguarda tali reati.

But this is not the topic: the problem is that, in the name of crimes of opinion, what have been modified are regulations that have absolutely nothing to do with crimes of opinion, and nor is it even attributed in that way by the Criminal Code that relates to those crimes.

We must not discuss in relation to a need for an immediate urgency: if these regulations are in the code and if they are still there now, it means that we wish to protect the legislature, the regulations and the Italian State, in case some day in the future someone does, not a caricature, but a real attack against the State.

Ci dobbiamo chiedere oggi, finita la boutade della carica con il carro armato da «giocherellone» che doveva assaltare Venezia, se, in nome di quell'esigenza particolare, sia opportuno mantenere in vita una norma che un domani potrà risultare pericolosissima in quanto ha aperto il varco ad una possibilità di attentare all'integrità dello Stato, all'unità della nazione ed alla Costituzione senza bisogno di ricorrere alla violenza, perché di questo parliamo.

Today we have to ask ourselves, now that there’s an end to the "boutade" of the attack with the game of the armoured tank that would have attacked Venice, if , in the name of a particular need, it is appropriate to keep alive a regulation that one day in the future could be really dangerous as it has opened up the door to the possibility of an attack on the integrity of the State, to the unity of the nation and to the Constitution without the need to have recourse to violence, because this is what we are talking about.
