Ma proprio per queste ragioni sono perplesso di fronte ad alcune sue proposte di questi giorni.

However, it is precisely for this reason that I am so perplexed by a number of the proposals he has made in the past few days.

Dopo la discussa e discutibile intervista da lui rilasciata alcuni giorni addietro ad un quotidiano nazionale che a molti ha fatto pensare ad una sua conversione a favore della discrezionalità dell’azione penale e della possibile separazione delle carriere dei giudici da quella dei Pubblici Ministeri, in verità poi smentite dallo stesso Violante accusandoci di non averlo capito.

Following his much discussed and disputable interview published in a national newspaper a few days ago, which caused many people to think that he had changed his mind in favour of discretion as regards penal action and the possible separation of the judges’ duties and those of the Public Prosecutors, however, in reality, this was later denied by Violante himself, who claimed that his statements had been misinterpreted.

Ieri è tornato sul tema con una lettera di suo pugno, e perciò non smentibile, in cui testualmente ha asserito che "...il PM deve operare "dopo" aver acquisito una notizia di reato e la polizia deve operare invece per accertare "se" sia stato commesso un reato dandone notizia al PM...".

Yesterday he once again touched on this topic in a letter written in his own hand, and which is therefore undeniable, wherein he states that: "...the Public Prosecution must get to work "after" having received notification of a crime, while the Police must instead ascertain "whether" a crime has been committed and then notify the Public Prosecutor"...

Insomma, secondo l’ultimo Violante, bisogna fare una riforma che impedisca al Procuratore della Repubblica di acquisire autonomamente le notizie di reato.

In other words then, according to the latter Violante, the system must be reformed so as to prevent the Public Prosecutor from independently ascertaining whether or not a crime has been committed.

E perché mai deve accontentarsi solo di quello che gli passano gli organi di polizia giudiziaria che, con tutto il rispetto per i singoli e per l’istituzione, sono pur sempre sotto la dipendenza gerarchica del Ministero dell’Interno o della Difesa o dell’Economia e quindi del Governo in carica?

Furthermore, why should he/she simply be satisfied with what the judicial police institutions choose to pass on to him/her when, to all intents and purposes and with all due respect for the individuals and the institutions involved, the institutions are still responsible to the Ministry of Internal Affairs, or the Ministry of Defence, or the Ministry for Economic Development and, therefore, to the Government in power?

And finally, why should the Public Prosecution be prohibited from doing precisely that which it is entitled to ask others to do?

Is there anyone who honestly believes that Buscetta would have turned state witness if he had been faced with a simple policeman, especially knowing full well that the officer would, in any event, have had to report the matter to the Government of the day?

Furthermore, is there anyone who honestly believes that the Mani Pulite (Clean Hands) inquiry, whose investigations eventually went as high as ministers in office and Government leaders, would have achieved the same success had it been held in the Police Station?
