Who is he?

The European Ombudsman is P. Nikiforos Diamandouros, former national ombudsman of Greece. He was elected by the European Parliament and has held office since 1 April 2003. The Parliament elected the first European Ombudsman in 1995.

Il Mediatore europeo è il professor P. Nikiforos Diamandouros, già difensore civico nazionale della Grecia. È stato eletto dal Parlamento europeo ed ha preso funzioni il 1° aprile del 2003. Il primo Mediatore europeo era stato eletto dal Parlamento europeo nel 1995.

What does he do?

Di cosa si occupa?

The European Ombudsman investigates complaints about maladministration in the institutions and bodies of the European Union. The institutions include, for example, the European Commission, the Council of the European Union and the European Parliament. The European Agency for the Evaluation of Medicinal Products and the European Foundation for the Improvement of Living and Working Conditions are examples of Union bodies that he can investigate. Only the Court of Justice and the Court of First Instance acting in their judicial role do not fall within his jurisdiction.

Il Mediatore europeo conduce indagini su casi di cattiva amministrazione nell'azione delle istituzioni ed organi comunitari. Tra le prime annoveriamo a titolo di esempio la Commissione europea, il Consiglio dell'Unione europea ed il Parlamento europeo. Tra gli organi comunitari che possono essere oggetto di indagine da parte del Mediatore europeo annoveriamo la Fondazione europea per la formazione professionale e l'Agenzia europea dell'ambiente. Solo la Corte di giustizia ed il tribunale di primo grado nell'esercizio delle loro funzioni giurisdizionali non rientrano nella sua giurisdizione.

The Ombudsman usually conducts inquiries on the basis of complaints but can also launch inquiries on his own initiative.

Il Mediatore normalmente conduce le sue indagini sulla base di denunce, ma ha anche la possibilità di aprirne di propria iniziativa.

What does he not do?

The Ombudsman cannot investigate complaints against national, regional or local authorities in the Member States, even when the complaints are about European Union matters. Examples of such authorities are government departments, state agencies and local councils. The Ombudsman is not an appeals body for decisions taken by national courts or ombudsmen. The Ombudsman cannot investigate complaints against businesses or private individuals.

Il Mediatore non può aprire indagini nei confronti di autorità a livello nazionale regionale o locale degli Stati membri, anche nel caso in cui le denunce siano relative a materie comunitarie. Esempi di queste autorità sono dipartimenti governativi, agenzie statali o consigli locali. Il Mediatore non é uno strumento di appello contro le decisioni dei tribunali nazionali o dei difensori civici. Il Mediatore non può aprire indagini nei confronti di imprese o di singoli individui.

What complaints can he deal with?

Che tipo di denunce può trattare?

The Ombudsman investigates cases of poor or failed administration. Many of the complaints lodged with the Ombudsman concern administrative delay, lack of transparency or refusal of access to information. Some concern work relations between the European institutions and their agents, recruitment of staff and the running of competitions. Others are related to contractual relations between the European institutions and private firms.

Il Mediatore indaga su casi di cattiva o carente amministrazione. Le denunce presentate al Mediatore riguardano ritardi amministrativi, mancanza di trasparenza o rifiuto di accesso all'informazione. Alcune riguardano le relazioni tra le istituzioni europee ed i loro funzionari, le assunzioni di personale e l'organizzazione di concorsi. Altre sono relative a relazioni contrattuali tra le istituzioni comunitarie ed imprese private.

What if he cannot handle the complaint?

E se in Mediatore non può trattare la denuncia?

If the Ombudsman is not able to investigate the complaint — for example, if it concerns national, regional or local administrations in the Member States or if it is not about maladministration — he will do his best to advise you of another body that could help. This may be a national or regional ombudsman or a committee on petitions in a national or regional parliament.

Se il Mediatore non può trattare la denuncia -in quanto, ad esempio, presentata nei confronti di istituzioni nazionali, regionali o locali degli Stati membri o in quanto non relativa all'attività amministrativa - la informerà sull'organo che potrà aiutarla. Si potrà trattare di un difensore civico nazionale o regionale, o di una commissione per le petizioni.

Who can complain and how?

Any citizen of the Union or any natural or legal person residing or having its registered office in an EU Member State can lodge a complaint with the Ombudsman by mail, fax or e-mail. A complaint form is available from the Ombudsman's office and can be downloaded from the Ombudsman's website.

Ogni cittadino dell'Unione o residente in uno Stato membro può presentare una denuncia al Mediatore europeo per posta, fax o posta elettronica. Lo stesso diritto è attribuito alle imprese, associazioni ed altri organismi con sede ufficiale nell'Unione. Il formulario di denuncia è disponibile presso l'ufficio del Mediatore e può essere scaricato dal sito Internet del Mediatore.

What outcome can be expected?

The Ombudsman may simply need to inform the institution concerned about a complaint in order for it to resolve the problem. If the case is not resolved satisfactorily during the course of the inquiries, the Ombudsman will try to find a friendly solution which puts right the case of maladministration and satisfies the complainant. If the attempt at conciliation fails, the Ombudsman can make recommendations to solve the case. If the institution does not accept his recommendations, he can make a special report to the European Parliament.

Il Mediatore può semplicemente informare l'istituzione denunciata del ricorso lasciando ad essa la risoluzione del problema. Se il problema non è risolto in maniera soddisfacente nel corso delle indagini, il Mediatore cercherà di addivenire ad una soluzione amichevole che elimini il caso di cattiva amministrazione e soddisfi il denunciante. Se il tentativo di conciliazione fallisce, il Mediatore può formulare delle raccomandazioni all'istituzione al fine di risolvere il problema. Se l'istituzione non accetta la raccomandazione, il Mediatore può presentare una relazione speciale al Parlamento europeo.

The European Commission agreed to reconsider a decision to co-finance the contruction of a dual carriageway after an inquiry by the Ombudsman. An Irish citizen had complained because no proper environmental study of the planned dual carriageway had been done. During the Ombudsman's inquiry, the Commission carried out a study and concluded that the proposed dual carriageway was in breach of EU policy and law.

Dopo l'intervento del Mediatore, la Commissione europea ha accettato di non procedere alla riduzione di 20.000 € di una sovvenzione per un progetto pilota. Il Mediatore aveva fatto notare alla Commissione che l'organizzazione italiana coinvolta nel progetto relativo all'assistenza delle comunità costiere peschiere, aveva addotto tutte le prove necessarie a comprovare l'effettivo lavoro svolto.

A Belgian architect was given a second chance in a call for tenders organised by the European Parliament after she complained to the Ombudsman. The Parliament agreed to re-launch the call after it emerged that the complainant had been treated unfairly.

Dopo avere presentato una denuncia al Mediatore europeo, un architetto belga ha avuto una seconda opportunità in una gara d'appalto bandita dal Parlamento europeo. Il Parlamento ha accettato di ricominciare la procedura dopo che era stato stabilito che il denunciante aveva ricevuto un trattamento iniquo.

Statewatch, a UK-based group monitoring civil liberties in the EU, obtained documents from the Council of the European Union after the Ombudsman intervened. The Council had refused to release the documents but reconsidered its initial decision in light of the arguments presented by the Ombudsman.
