Nuova direttiva sull'emissione deliberata di OGM

In accordance with the precautionary principle and in view of the potential risk to the environment and human health of the release of genetically modified organisms (GMOs), the Directive strengthens the legislative framework on the deliberate release of GMOs into the environment and the placing of GMOs on the market.

Conformemente al principio di precauzione e tenuto conto dei rischi per l'ambiente e la salute umana che l'emissione deliberata nell'ambiente di organismi geneticamente modificati (OGM) può determinare, la presente direttiva mira a rafforzare il quadro legislativo relativo all'emissione volontaria e all'immissione in commercio degli OGM.

In particular, the Directive improves the efficiency and transparency of the authorisation procedures for such deliberate release and placing on the market, establishes a common methodology for risk assessment and a safety mechanism. It also introduces mandatory public consultation and GMO labelling.

In particolare, la direttiva migliora l'efficacia e la trasparenza della procedura di autorizzazione dell'emissione volontaria e dell'immissione in commercio degli OGM, istituisce un metodo comune di valutazione dei rischi e un meccanismo di salvaguardia e rende obbligatoria la consultazione del pubblico e l'etichettatura degli OGM.

Directive 2001/18/EC of the European Parliament and of the Council of 12 March 2001 on the deliberate release into the environment of genetically modified organisms and repealing Council Directive 90/220/EEC [ see amending acts ].

SINTESI

The main aim of this Directive is to make the procedure for granting consent to the deliberate release and placing on the market of GMOs more efficient and more transparent, to limit such consent to a period of ten years (renewable) and to introduce compulsory monitoring after GMOs have been placed on the market.

Tale direttiva mira principalmente a rendere la procedura prevista per autorizzare l'emissione deliberata nell'ambiente e l'immissione in commercio di OGM più efficace e trasparente, a limitare l'autorizzazione a un periodo di dieci anni, rinnovabile, e ad introdurre un controllo obbligatorio dopo l'immissione in commercio degli OGM.

It also provides for a common methodology to assess the risks associated with the release of GMOs (the principles applying to environmental risk assessment are set out in Annex II to the Directive) and a mechanism allowing the release of the GMOs to be modified, suspended or terminated where new information becomes available on the risks of such release.

Prevede anche una metodologia comune per effettuare la valutazione dei rischi connessi all'emissione degli OGM nell'ambiente (i principi applicabili alla valutazione dei rischi ambientali sono contenuti nell'allegato II della direttiva) e un meccanismo che permette di modificare, sospendere o cessare l'emissione degli OGM nell'ambiente qualora si disponga di nuove informazioni sui rischi connessi.

Public consultation and GMO labelling are made compulsory.

Rende obbligatorie la consultazione del pubblico e l'etichettatura degli OGM.

The system of exchange of information contained in notifications, set up under Directive 90/220/EEC, is maintained.

È mantenuto il sistema di scambio delle informazioni contenute nella notifica, stabilito dalla direttiva 90/220/CE.

Under the new Directive, the Commission is obliged to consult the competent scientific committees on any question which may affect human health and/or the environment. It may also consult ethical committees.

In virtù delle presente direttiva la Commissione è tenuta a consultare i comitati scientifici competenti in merito a tutte le questioni che potrebbero avere ripercussioni sulla salute umana e/o sull'ambiente e può consultare comitati etici.

The Directive requires registers to be established for the purpose of recording information on genetic modifications in GMOs and on the location of GMOs.

La direttiva stabilisce l'istituzione di uno o più registri delle informazioni sulle modifiche genetiche e sulla localizzazione degli OGM.

Rules on the operation of these registers are laid down in Decision 2004/204/EC.

Every three years, the Commission must publish a summary of the measures taken in the Member States to implement the Directive, and a report on experience with GMOs placed on the market (the first report was due to be published in 2003).

Ogni tre anni la Commissione pubblica un riepilogo delle misure adottate dagli Stati ai fini dell'attuazione della presente direttiva. Essa deve inoltre pubblicare, ogni tre anni, una relazione sulle esperienze acquisite in materia d'immissione di OGM sui mercati (la prima relazione era prevista per il 2003).

An annual report on ethical issues will also be published.

Ogni anno verrà pubblicata una relazione sulle questioni etiche.

The Directive invited the Commission to present a proposal for implementing the Cartagena Protocol on biosafety, which led to the adoption of Regulation (EC) No 1946/2003 of the European Parliament and of the Council on transboundary movements of genetically modified organisms .

La Commissione è invitata a presentare una proposta volta ad attuare il protocollo di Cartagena sulla biosicurezza. Ciò ha condotto all'adozione del regolamento (CE) n. 1946/2003 del Parlamento europeo e del Consiglio sui movimenti transfrontalieri degli organismi geneticamente modificati .

Directive 90/220/EEC on the deliberate release into the environment of genetically modified organisms will be repealed by the present Directive from 17 October 2002.

La direttiva 90/220/CE sull'emissione deliberata nell'ambiente di organismi geneticamente modificati è abrogata dalla presente direttiva a decorrere dal 17 ottobre 2002.

The authorisation allows the product to be put to the same uses as any other oilseed rape, with the exception of cultivation and uses as or in food, under certain conditions, in particular the mandatory inclusion of certain information either on a label or in a document accompanying the product.

The authorisation also contains certain obligations with regard to the monitoring of the product and its effects on human and animal health, the provision of information on the product to users and competent authorities, its safety, and the monitoring networks set up by the competent authority in the Netherlands.
