TITLE I

Common provisions

 

Article A 

By this Treaty, the HIGH CONTRACTING PARTIES establish among themselves a EUROPEAN UNION, hereinafter called 'the Union'.

Con il presente trattato, le ALTE PARTI CONTRAENTI istituiscono tra loro un'UNIONE EUROPEA, in appresso denominata "Unione".

This Treaty marks a new stage in the process of creating an ever closer union among the peoples of Europe, in which decisions are taken as closely as possible to the citizen.

Il presente trattato segna una nuova tappa nel processo di creazione di un'unione sempre più stretta tra i popoli dell'Europa, in cui le decisioni siano prese il più vicino possibile ai cittadini.

The Union shall be founded on the European Communities, supplemented by the policies and forms of cooperation established by this Treaty. Its task shall be to organize, in a manner demonstrating consistency and solidarity, relations between the Member States and between their peoples.

L'Unione è fondata sulle Comunità europee, integrate dalle politiche e forme di cooperazione instaurate dal presente trattato. Essa ha il compito di organizzare in modo coerente e solidale le relazioni tra gli Stati membri e tra i loro popoli.

Article B 

The Union shall set itself the following objectives:

Articolo B  

L'Unione si prefigge i seguenti obiettivi:

  • to promote economic and social progress which is balanced and sustainable, in particular through the creation of an area without internal frontiers, through the strengthening of economic and social cohesion and through the establishment of economic and monetary union, ultimately including a single currency in accordance with the provisions of this Treaty;
  • promuovere un progresso economico e sociale equilibrato e sostenibile, segnatamente mediante la creazione di uno spazio senza frontiere interne, il rafforzamento della coesione economica e sociale e l'instaurazione di un'unione economica e monetaria che comporti a termine una moneta unica, in conformità delle disposizioni del presente trattato;
  • to assert its identity on the international scene, in particular through the implementation of a common foreign and security policy including the eventual framing of a common defence policy, which might in time lead to a common defence;
  • affermare la sua identità sulla scena internazionale, segnatamente mediante l'attuazione di una politica estera e di sicurezza comune, ivi compresa la definizione a termine di una politica di difesa comune che potrebbe, successivamente, condurre ad una difesa comune;
  • to strengthen the protection of the rights and interests of the nationals of its Member States through the introduction of a citizenship of the Union;
  • rafforzare la tutela dei diritti e degli interessi dei cittadini dei suoi Stati membri mediante l'instituzione di una cittadinanza dell'Unione;
  • to develop close cooperation on justice and home affairs;
  • sviluppare una stretta cooperazione nel settore della giustizia e degli affari interni;
  • to maintain in full the acquis communautaire and build on it with a view to considering, through the procedure referred to in Article N(2), to what extent the policies and forms of cooperation introduced by this Treaty may need to be revised with the aim of ensuring the effectiveness of the mechanisms and the institutions of the Community.
  • mantenere integralmente l'"acquis" comunitario e svilupparlo al fine di valutare, attraverso la procedura prevista all'articolo N, paragrafo 2, in quale misura si renda necessario rivedere le politiche e le forme di cooperazione instaurate dal presente trattato allo scopo di garantire l'efficacia dei meccanismi e delle istituzioni comunitarie.

The objectives of the Union shall be achieved as provided in this Treaty and in accordance with the conditions and the timetable set out therein while respecting the principle of subsidiarity as defined in Article 3b of the Treaty establishing the European Community.

Gli obiettivi dell'Unione saranno perseguiti conformemente alle disposizioni del presente trattato, alle condizioni e secondo il ritmo ivi fissati, nel rispetto del principio di sussidiarietà definito all'articolo 3 B del trattato che istituisce la Comunità europea.

Article C 

The Union shall be served by a single institutional framework which shall ensure the consistency and the continuity of the activities carried out in order to attain its objectives while respecting and building upon the acquis communautaire.

Articolo C  

L'Unione dispone di un quadro istituzionale unico che assicura la coerenza e la continuità delle azioni svolte per il perseguimento dei suoi obiettivi, rispettando e sviluppando nel contempo l'"acquis" comunitario.

The Union shall in particular ensure the consistency of its external activities as a whole in the context of its external relations, security, economic and development policies. The Council and the Commission shall be responsible for ensuring such consistency. They shall ensure the implementation of these policies, each in accordance with its respective powers.

L'Unione assicura in particolare la coerenza globale della sua azione esterna nell'ambito delle politiche in materia di relazioni esterne, di sicurezza, di economia e di sviluppo. Il Consiglio e la Commissione hanno la responsabilità di garantire tale coerenza. Essi provvedono, nell'ambito delle rispettive competenze, ad attuare dette politiche.

Article D 

The European Council shall provide the Union with the necessary impetus for its development and shall define the general political guidelines thereof.

Il Consiglio europeo dà all'Unione l'impulso necessario al suo sviluppo e ne definisce gli orientamenti politici generali.

The European Council shall bring together the Heads of State or Government of the Member States and the President of the Commission. They shall be assisted by the Ministers for Foreign Affairs of the Member States and by a Member of the Commission. The European Council shall meet at least twice a year, under the chairmanship of the Head of State or Government of the Member State which holds the Presidency of the Council.

Il Consiglio Europeo riunisce i capi di Stato o di governo degli Stati membri nonché il presidente della Commissione. Essi sono assistiti dai ministri incaricati degli Affari esteri degli Stati membri e da un membro della Commissione. Il Consiglio europeo si riunisce almeno due volte l'anno sotto la presidenza del capo di Stato o di governo dello Stato membro che esercita la presidenza del Consiglio.

The European Council shall submit to the European Parliament a report after each of its meetings and a yearly written report on the progress achieved by the Union.

Il Consiglio europeo presenta al Parlamento europeo una relazione dopo ciascuna delle sue riunioni, nonché una relazione scritta annuale sui progressi compiuti dall'Unione.

Article E 

The European Parliament, the Council, the Commission and the Court of Justice shall exercise their powers under the conditions and for the purposes provided for, on the one hand, by the provisions of the Treaties establishing the European Communities and of the subsequent Treaties and Acts modifying and supplementing them and, on the other hand, by the other provisions of this Treaty.

Articolo E  

Il Parlamento europeo, il Consiglio, la Commissione e la Corte di giustizia esercitano le loro attribuzioni alle condizioni e ai fini previsti, da un lato, dalle disposizioni dei trattati che istituiscono le Comunità europee, nonché dalle disposizioni dei successivi trattati e atti recanti modifiche o integrazioni delle stesse e, dall'altro, dalle altre disposizioni del presente trattato.

Article F 

1. The Union shall respect the national identities of its Member States, whose systems of government are founded on the principles of democracy.

1. L'Unione rispetta l'identità nazionale dei suoi Stati membri, i cui sistemi di governo si fondano sui principi democratici.

2. The Union shall respect fundamental rights,as guaranteed by the European Convention for the Protection of Human Rights and Fundamental Freedoms signed in Rome on 4 November 1950 and as they result from the constitutional traditions common to the Member States, as general principles of Community law.

2. L'Unione rispetta i diritti fondamentali quali sono garantiti dalla Convenzione europea per la salvaguardia dei diritti dell'uomo e delle libertà fondamentali, firmata a Roma il 4 novembre 1950, e quali risultano dalle tradizioni costituzionali comuni degli Stati membri, in quanto principi generali del diritto comunitario.

3. The Union shall provide itself with the means necessary to attain its objectives and carry through its policies

TITLE V

Provisions on a common foreign and security policy

Article J

A common foreign and security policy is hereby established which shall be governed by the following provisions.

1. The Union and its Member States shall define and implement a common foreign and security policy, governed by the provisions of this Title and covering all areas of foreign and security policy.

2. The objectives of the common foreign and security policy shall be:

  • to safeguard the common values, fundamental interests and independence of the Union;
  • to strengthen the security of the Union and its Member States in all ways;
  • to preserve peace and strengthen international security, in accordance with the principles of the United Nations Charter as well as the principles of the Helsinki Final Act and the objectives of the Paris Charter;
  • to promote international cooperation;
  • to develop and consolidate democracy and the rule of law, and respect for human rights and fundamental freedoms.

2. Gli obiettivi della politica estera e di sicurezza comune sono i seguenti:

  • difesa dei valori comuni, degli interessi fondamentali e dell'indipendenza dell'Unione;
  • rafforzamento della sicurezza dell'Unione e dei suoi Stati membri in tutte le sue forme;
  • mantenimento della pace e rafforzamento della sicurezza internazionale, conformemente ai principi della Carta delle Nazioni Unite, nonché ai principi dell'Atto finale di Helsinki e agli obiettivi della Carta di Parigi;
  • promozione della cooperazione internazionale;
  • sviluppo e consolidamento della democrazia e dello Stato di diritto, nonché rispetto dei diritti dell'uomo e delle libertà fondamentali.

3. The Union shall pursue these objectives:

  • by establishing systematic cooperation between Member States in the conduct of policy, in accordance with Article J.2;
     
  • by gradually implementing, in accordance with Article J.3, joint action in the areas in which the Member States have important interests in common.

3. L'Unione persegue tali obiettivi:

  • instaurando una cooperazione sistematica tra gli Stati membri per la condotta della loro politica, conformemente alle disposizioni dell'articolo J.2;
  • realizzando gradualmente, in conformità delle disposizioni dell'articolo J.3, azioni comuni nei settori in cui gli Stati membri abbiano in comune interessi rilevanti.

4. The Member States shall support the Union's external and security policy actively and unreservedly in a spirit of loyalty and mutual solidarity. They shall refrain from any action which is contrary to the interests of the Union or likely to impair its effectiveness as a cohesive force in international relations. The Council shall ensure that these principles are complied with.

4. Gli Stati membri sostengono attivamente e senza riserve la politica estera e di sicurezza dell'Unione in uno spirito di lealtà e di solidarietà reciproca. Essi si astengono da qualsiasi azione contraria agli interessi dell'Unione o tale da nuocere alla sua efficacia come elemento di coesione nelle relazioni internazionali. Il Consiglio provvede affinché detti principi siano rispettati.

Article J.2  

1. Member States shall inform and consult one another within the Council on any matter of foreign and security policy of general interest in order to ensure that their combined influence is exerted as effectively as possible by means of concerted and convergent action.

1. Gli Stati membri si informano reciprocamente e si concertano in sede di Consiglio in merito a qualsiasi questione di politica estera e di sicurezza di interesse generale per garantire che la loro influenza combinata si eserciti nel modo più efficace attraverso la convergenza delle loro azioni.

2. Whenever it deems it necessary, the Council shall define a common position.


Member States shall ensure that their national policies conform to the common positions.

2. Ogniqualvolta lo ritenga necessario, il Consiglio definisce una posizione comune.

Gli Stati membri provvedono affinché le loro politiche nazionali siano conformi alle posizioni comuni.

3. Member States shall coordinate their action in international organizations and at international conferences. They shall uphold the common positions in such forums.

In international organizations and at international conferences where not all the Member States participate, those which do take part shall uphold the common positions.

3. Gli Stati membri coordinano la propria azione nelle organizzazioni internazionali e in occasione di conferenze internazionali. In queste sedi essi difendono le posizioni comuni.

Nelle organizzazioni internazionali e in occasione di conferenze internazionali alle quali non tutti gli Stati membri partecipano, quelli che vi partecipano difendono le posizioni comuni.

Article J.3  

The procedure for adopting joint action in matters covered by the foreign and security policy shall be the following:

La procedura per adottare un'azione comune nei settori che rientrano nella politica estera e di sicurezza è la seguente:

  1. The Council shall decide, on the basis of general guidelines from the European Council, that a matter should be the subject of joint action.

Whenever the Council decides on the principle of joint action, it shall lay down the specific scope, the Union's general and specific objectives in carrying out such action, if necessary its duration, and the means, procedures and conditions for its implementation.

  1. In base ad orientamenti generali del Consiglio europeo, il Consiglio decide che una questione forma oggetto di un'azione comune.

Il Consiglio, quando adotta il principio di un'azione comune, ne fissa la portata precisa, gli obiettivi generali e particolari che l'Unione si prefigge nella realizzazione di detta azione, nonché i mezzi, le procedure, le condizioni e, se necessario, la durata applicabili alla sua attuazione.

  1. The Council shall, when adopting the joint action and at any stage during its development, define those matters on which decisions are to be taken by a qualified majority.

Where the Council is required to act by a qualified majority pursuant to the preceding subparagraph, the votes of its members shall be weighted in accordance with Article 148(2) of the Treaty establishing the European Community, and for their adoption, acts of the Council shall require at least 62 votes in favour, cast by at least 10 members.

  1. Nell'adottare l'azione comune e in qualsiasi fase del suo svolgimento, il Consiglio definisce le questioni per le quali le decisioni devono essere prese a maggioranza qualificata.

Per le deliberazioni del Consiglio che richiedono la maggioranza qualificata in applicazione del primo comma, ai voti dei membri è attribuita la ponderazione prevista dall'articolo 148, paragrafo 2, del trattato che istituisce la Comunità europea e le deliberazioni sono valide se hanno raccolto almeno 62 voti che esprimano il voto favorevole di almeno 10 membri

  1. If there is a change in circumstances having a substantial effect on a question subject to joint action, the Council shall review the principles and objectives of that action and take the necessary decisions. As long as the Council has not acted, the joint action shall stand.
  1. Se si produce un cambiamento di circostanze che ha una netta incidenza su una questione oggetto di un'azione comune, il Consiglio rivede i principi e gli obiettivi di detta azione e adotta le decisioni necessarie. L'azione comune resta valida sinché il Consiglio non abbia deliberato.
  1. Joint actions shall commit the Member States in the positions they adopt and in the conduct of their activity.

  1. Whenever there is any plan to adopt a national position or take national action pursuant to a joint action, information shall be provided in time to allow, if necessary, for prior consultations within the Council. The obligation to provide prior information shall not apply to measures which are merely a national transposition of Council decisions.
  1. Qualsiasi presa di posizione o azione nazionale prevista in applicazione di un'azione comune forma oggetto di informazione entro termini che permettano, se necessario, una concertazione preliminare in sede di Consiglio.   1. In cases of imperative need arising from changes in the situation and failing a Council decision, Member States may take the necessary measures as a matter of urgency having regard to the general objectives of the joint action. The Member State concerned shall inform the Council immediately of any such measures.
  1. In caso di assoluta necessità connessa con l'evoluzione della situazione e in mancanza di una decisione del Consiglio, gli Stati membri possono prendere d'urgenza le misure necessarie, tenuto conto degli obiettivi generali dell'azione comune. Lo Stato membro che prende tali misure ne informa immediatamente il Consiglio.
  1. Should there be any major difficulties in implementing a joint action, a Member State shall refer them to the Council which shall discuss them and seek appropriate solutions. Such solutions shall not run counter to the objectives of the joint action or impair its effectiveness.
  1. In caso di difficoltà rilevanti nell'applicazione di un'azione comune, uno Stato membro ne investe il Consiglio che delibera al riguardo e ricerca le soluzioni appropriate. Queste ultime non possono essere in contrasto con gli obiettivi dell'azione né nuocere alla sua efficacia.

Article J.4  

1. The common foreign and security policy shall include all questions related to the security of the Union, including the eventual framing of a common defence policy, which might in time lead to a common defence.

1. La politica estera e di sicurezza comune comprende tutte le questioni relative alla sicurezza dell'Unione europea, ivi compresa la definizione a termine di una politica di difesa comune, che potrebbe successivamente condurre a una difesa comune.

2. The Union requests the Western European Union (WEU), which is an integral part of the development of the Union, to elaborate and implement decisions and actions of the Union which have defence implications. The Council shall, in agreement with the institutions of the WEU, adopt the necessary practical arrangements.

2. L'Unione chiede all'Unione dell'Europa occidentale (UEO), che fa parte integrante dello sviluppo dell'Unione europea, di elaborare e di porre in essere le decisioni e le azioni dell'Unione aventi implicazioni nel settore della difesa. Il Consiglio adotta, d'intesa con le istituzioni dell'UEO, le necessarie modalità pratiche.

3. Issues having defence implications dealt with under this Article shall not be subject to the procedures set out in Article J.3.

3. Le questioni aventi implicazioni nel settore della difesa che sono disciplinate dal presente articolo non sono soggette alle procedure di cui all'articolo J.3.

4. The policy of the Union in accordance with this Article shall not prejudice the specific character of the security and defence policy of certain Member States and shall respect the obligations of certain Member States under the North Atlantic Treaty and be compatible with the common security and defence policy established within that framework.

La politica dell'Unione ai sensi del presente articolo non pregiudica il carattere specifico della politica di sicurezza e di difesa di taluni Stati membri, rispetta gli obblighi derivanti per alcuni Stati membri dal trattato dell'Atlantico del Nord ed è compatibile con la politica di sicurezza e di difesa comune adottata in questo ambito.

5. The provisions of this Article shall not prevent the development of closer cooperation between two or more Member States on a bilateral level,in the framework of the WEU and the Atlantic Alliance, provided such cooperation does not run counter to or impede that provided for in this Title.

5. Le disposizioni del presente articolo non ostano allo sviluppo di una più stretta cooperazione fra due o più Stati membri a livello bilaterale, nell'ambito dell'UEO e dell'Alleanza atlantica, purché detta cooperazione non contravvenga a quella prevista dal presente titolo né la ostacoli.

6. With a view to furthering the objective of this Treaty, and having in view the date of 1998 in the context of Article XII of the Brussels Treaty, the provisions of this Article may be revised as provided for in Article N(2) on the basis of a report to be presented in 1996 by the Council to the European Council, which shall include an evaluation of the progress made and the experience gained until then.

6. Per promuovere il conseguimento dell'obiettivo del presente trattato e tenuto conto della scadenza del 1998 nell'ambito dell'articolo XII del trattato di Bruxelles, le disposizioni del presente articolo potranno essere rivedute, come previsto all'articolo N, paragrafo 2, in base a una relazione che il Consiglio presenterà al Consiglio europeo nel 1996, contenente una valutazione dei progressi attuati e dell'esperienza acquisita sino a quel momento.

Article J.5  

1. The Presidency shall represent the Union in matters coming within the common foreign and security policy.

Articolo J.5  

1. La presidenza rappresenta l'Unione per le materie che rientrano nella politica estera e di sicurezza comune.

2. The Presidency shall be responsible for the implementation of common measures; in that capacity it shall in principle express the position of the Union in international organizations and international conferences.

2. La presidenza è responsabile dell'attuazione delle azioni comuni; a questo titolo essa esprime in linea di massima la posizione dell'Unione nelle organizzazioni internazionali e in occasione di conferenze internazionali.

3. In the tasks referred to in paragraphs 1 and 2, the Presidency shall be assisted if need be by the previous and next Member States to hold the Presidency. The Commission shall be fully associated in these tasks.

3. Nell'esecuzione dei compiti di cui ai punti 1 e 2 la presidenza è assistita eventualmente dallo Stato membro che ha esercitato la presidenza precedente e da quello che eserciterà la presidenza successiva. La Commissione è pienamente associata a tali compiti.

4. Without prejudice to Article J.2(3) and Article J.3(4), Member States represented in international organizations or international conferences where not all the Member States participate shall keep the latter informed of any matter of common interest.

4. Fatte salve le disposizioni dell'articolo J.2, punto 3, e dell'articolo J.3, punto 4, gli Stati membri rappresentati nelle organizzazioni internazionali o in occasione di conferenze internazionali in cui non tutti gli Stati membri lo sono, tengono questi ultimi informati in merito ad ogni questione di interesse comune.

Member States which are also members of the United Nations Security Council will concert and keep the other Member States fully informed. Member States which are permanent members of the Security Council will, in the execution of their functions, ensure the defence of the positions and the interests of the Union, without prejudice to their responsibilities under the provisions of the United Nations Charter.

Gli Stati membri che sono anche membri del Consiglio di sicurezza delle Nazioni Unite si concerteranno e terranno pienamente informati gli altri Stati membri. Gli Stati membri che sono membri permanenti del Consiglio di sicurezza procurano, nell'esercizio delle loro funzioni, di difendere le posizioni e l'interesse dell'Unione, fatte salve le responsabilità che loro incombono in forza delle disposizioni della Carta delle Nazioni Unite.

Article J.6  

The diplomatic and consular missions of the Member States and the Commission Delegations in third countries and international conferences, and their representations to international organizations, shall cooperate in ensuring that the common positions and common measures adopted by the Council are complied with and implemented.

Le missioni diplomatiche e consolari degli Stati membri e le delegazioni della Commissione nei paesi terzi e nelle conferenze internazionali, nonché le loro rappresentanze presso le organizzazioni internazionali, si concertano per garantire il rispetto e l'attuazione delle posizioni comuni e delle azioni comuni adottate dal Consiglio.

They shall step up cooperation by exchanging information, carrying out joint assessments and contributing to the implementation of the provisions referred to in Article 8c of the Treaty establishing the European Community.

Esse intensificano la loro cooperazione procedendo a scambi di informazioni e a valutazioni comuni e contribuendo all'attuazione delle disposizioni previste dall'articolo 8 c del trattato che istituisce la Comunità Europea.

Article J.7  

The Presidency shall consult the European Parliament on the main aspects and the basic choices of the common foreign and security policy and shall ensure that the views of the European Parliament are duly taken into consideration. The European Parliament shall be kept regularly informed by the Presidency and the Commission of the development of the Union's foreign and security policy.

La presidenza consulta il Parlamento europeo sui principali aspetti e sulle scelte fondamentali della politica estera e di sicurezza comune e provvede affinché le opinioni del Parlamento europeo siano debitamente prese in considerazione. Il Parlamento europeo è regolarmente informato dalla presidenza e dalla Commissione in merito allo sviluppo della politica estera e di sicurezza dell'Unione.

The European Parliament may ask questions of the Council or make recommendations to it. It shall hold an annual debate on progress in implementing the common foreign and security policy.

Il Parlamento europeo può rivolgere interrogazioni o formulare raccomandazioni al Consiglio. Esso procede ogni anno ad un dibattito sui progressi compiuti nell'attuazione della politica estera e di sicurezza comune.

Article J.8  

1. The European Council shall define the principles of and general guidelines for the common foreign and security policy.

Articolo J.8  

1. Il Consiglio europeo definisce i principi e gli orientamenti generali della politica estera e di sicurezza comune.

2. The Council shall take the decisions necessary for defining and implementing the common foreign and security policy on the basis of the general guidelines adopted by the European Council. It shall ensure the unity, consistency and effectiveness of action by the Union.

2. Il Consiglio prende le decisioni necessarie per la definizione e l'attuazione della politica estera e di sicurezza comune in base agli orientamenti generali adottati dal Consiglio europeo. Esso provvede all'unità, alla coerenza e all'efficacia dell'azione dell'Unione.

The Council shall act unanimously, except for procedural questions and in the case referred to in Article J.3(2).

Il Consiglio delibera all'unanimità, tranne che per le questioni di procedura e nel caso di cui all'articolo J.3, punto 2.

3. Any Member State or the Commission may refer to the Council any question relating to the common foreign and security policy and may submit proposals to the Council.

3. Ogni Stato membro o la Commissione può sottoporre al Consiglio questioni che rientrano nella politica estera e di sicurezza comune e presentare proposte al Consiglio.

4. In cases requiring a rapid decision, the Presidency, of its own motion, or at the request of the Commission or a Member State, shall convene an extraordinary Council meeting within 48 hours or, in an emergency, within a shorter period.

4. Nei casi che richiedono una decisione rapida, la presidenza convoca d'ufficio o a richiesta della Commissione o di uno Stato membro, entro un termine di quarantotto ore o, in caso di emergenza, entro un termine più breve, una riunione straordinaria del Consiglio.

5. Without prejudice to Article 151 of the Treaty establishing the European Community, a Political Committee consisting of Political Directors shall monitor the international situation in the areas covered by common foreign and security policy and contribute to the definition of policies by delivering opinions to the Council at the request of the Council or on its own initiative. It shall also monitor the implementation of agreed policies, without prejudice to the responsibility of the Presidency and the Commission.

5. Fatto salvo l'articolo 151 del trattato che istituisce la Comunità Europea, un Comitato politico composto dei direttori politici segue la situazione internazionale nei settori che rientrano nella politica estera e di sicurezza comune e contribuisce a definire le politiche formulando pareri per il Consiglio, a richiesta di questo o di propria iniziativa. Sorveglia altresì l'attuazione delle politiche concordate, fatte salve le competenze della presidenza e della Commissione.

Article J.9  

The Commission shall be fully associated with the work carried out in the common foreign and security policy field.

La Commissione è pienamente associata ai lavori nel settore della politica estera e di sicurezza comune.

Article J.10  

On the occasion of any review of the security provisions under Article J.4,the Conference which is convened to that effect shall also examine whether any other amendments need to be made to provisions relating to the common foreign and security policy.

All'atto di un'eventuale revisione delle disposizioni relative alla sicurezza, conformemente all'articolo J.4, la Conferenza convocata a tal fine esamina anche se debbano essere apportati altri emendamenti alle disposizioni relative alla politica estera e di sicurezza comune.

Article J.11  

1. The provisions referred to in Articles 137, 138, 139 to 142, 146, 147, 150 to 153, 157 to 163 and 217 of the Treaty establishing the European Community shall apply to the provisions relating to the areas referred to in this Title.

1. Le disposizioni di cui agli articoli 137, 138, da 139 a 142, 146, 147, da 150 a 153, da 157 a 163 e 217 del trattato che istituisce la Comunità europea sono applicabili alle disposizioni relative ai settori di cui al presente titolo.

2. Administrative expenditure which the provisions relating to the areas referred to in this Title entail for the institutions shall be charged to the budget of the European Communities.

2. Le spese amministrative che le istituzioni devono sostenere per le disposizioni relative alla politica estera e di sicurezza comune sono a carico del bilancio delle Comunità europee.

The Council may also:

  • either decide unanimously that operational expenditure to which the implementation of those provisions gives rise is to be charged to the budget of the European Communities; in that event, the budgetary procedure laid down in the Treaty establishing the European Community shall be applicable;
  • or determine that such expenditure shall be charged to the Member States, where appropriate in accordance with a scale to be decided.

Il Consiglio può altresì:

  • decidere all'unanimità che le spese operative dovute all'attuazione di dette misure siano a carico del bilancio della Comunità europea; in tal caso si applica la procedura di bilancio prevista dal trattato che istituisce la Comunità europea;


     
  • o costatare che tali spese devono essere a carico degli Stati membri, eventualmente secondo un criterio di ripartizione da stabilirsi.

TITLE VI

Provisions on cooperation in the fields of justice and home affairs


Article K

Cooperation in the fields of justice and home affairs shall be governed by the following provisions.

La cooperazione nei settori della giustizia e degli affari interni è disciplinata dalle seguenti disposizioni.

Article K.1  

For the purposes of achieving the objectives of the Union, in particular the free movement of persons,and without prejudice to the powers of the European Community, Member States shall regard the following areas as matters of common interest:

Ai fini della realizzazione degli obiettivi dell'Unione, in particolare della libera circolazione delle persone, fatte salve le competenze della Comunità europea, gli Stati membri considerano questioni di interesse comune i settori seguenti:

  1. asylum policy;
  1. la politica di asilo;
  1. rules governing the crossing by persons of the external borders of the Member States and the exercise of controls thereon;
  1. le norme che disciplinano l'attraversamento delle frontiere esterne degli Stati membri da parte delle persone e l'espletamento dei relativi controlli;
  1. immigration policy and policy regarding nationals of third countries:
    1. conditions of entry and movement by nationals of third countries on the territory of Member States;
    2. conditions of residence by nationals of third countries on the territory of Member States, including family reunion and access to employment;
       
    3. combating unauthorized immigration, residence and work by nationals of third countries on the territory of Member States;
  1. la politica d'immigrazione e la politica da seguire nei confronti dei cittadini dei paesi terzi:
    1. le condizioni di entrata e circolazione dei cittadini dei paesi terzi nel territorio degli Stati membri;
    2. le condizioni di soggiorno dei cittadini dei paesi terzi nel territorio degli Stati membri, compresi il ricongiungimento delle famiglie e l'accesso all'occupazione;
    3. la lotta contro l'immigrazione, il soggiorno e il lavoro irregolari di cittadini dei paesi terzi nel territorio degli Stati membri;
  1. combating drug addiction in so far as this is not covered by (7) to (9);
  1. la lotta contro la tossicodipendenza, nella misura in cui questo settore non sia già contemplato dai punti 7, 8 e 9;
  1. combating fraud on an international scale in so far as this is not covered by (7) to (9);

  1. police cooperation for the purposes of preventing and combating terrorism, unlawful drug-trafficking and other serious forms of international crime, including if necessary certain aspects of customs cooperation, in connection with the organization of a Union-wide system for exchanging information within a European Police Office (Europol).

Article K.2  

1. The matters referred to in Article K.1 shall be dealt with in compliance with the European Convention for the Protection of Human Rights and Fundamental Freedoms of 4 November 1950 and the Convention relating to the Status of Refugees of 28 July 1951 and having regard to the protection afforded by Member States to persons persecuted on political grounds.

I settori contemplati dall'articolo K.1 vengono trattati nel rispetto della Convenzione europea per la salvaguardia dei diritti dell'uomo e delle libertà fondamentali, firmata a Roma il 4 novembre 1950, e della Convenzione relativa allo status dei rifugiati del 28 luglio 1951, tenendo conto della protezione che gli Stati membri concedono alle persone perseguitate per motivi politici.

2. This Title shall not affect the exercise of the responsibilities incumbent upon Member States with regard to the maintenance of law and order and the safeguarding of internal security.

2. Il presente titolo non osta all'esercizio delle responsabilità incombenti agli Stati membri per il mantenimento dell'ordine pubblico e la salvaguardia della sicurezza interna.

Article K.3  

1. In the areas referred to in Article K.1, Member States shall inform and consult one another within the Council with a view to coordinating their action. To that end, they shall establish collaboration between the relevant departments of their administrations.

1. Nei settori di cui all'articolo K.1, gli Stati membri si informano e si consultano reciprocamente, in seno al Consiglio, per coordinare la loro azione; essi instaurano a tal fine una collaborazione tra i servizi competenti delle loro amministrazioni.

2. The Council may:

  • on the initiative of any Member State or of the Commission, in the areas referred to in Article K.1(1) to (6);

2. Il Consiglio può,

  • on the initiative of any Member State, in the areas referred to in Article K.1(7) to (9):
    1. adopt joint positions and promote, using the appropriate form and procedures, any cooperation contributing to the pursuit of the objectives of the Union;
    2. adopt joint action in so far as the objectives of the Union can be attained better by joint action than by the Member States acting individually on account of the scale or effects of the action envisaged; it may decide that measures implementing joint action are to be adopted by a qualified majority;

       
    3. without prejudice to Article 220 of the Treaty establishing the European Community, draw up conventions which it shall recommend to the Member States for adoption in accordance with their respective constitutional requirements.

Unless otherwise provided by such conventions, measures implementing them shall be adopted wihtin the Council by a majority of two thirds of the High Contracting Parties.

Such conventions may stipulate that the Court of Justice shall have jurisdiction to interpret their provisions and to rule on any disputes regarding their application, in accordance with such arrangements as they may lay down.

Le convenzioni possono prevedere che la Corte di giustizia sia competente per interpretarne le disposizioni e per comporre le controversie connesse con la loro applicazione, secondo modalità che saranno precisate dalle medesime convenzioni.

Article K.4  

1. A Coordinating Committee shall be set up consisting of senior officials. In addition to its coordinating role, it shall be the task of the Committee to:

  • give opinions for the attention of the Council, either at the Council's request or on its own initiative;

2. The Commission shall be fully associated with the work in the areas referred to in this Title.

3. The Council shall act unanimously, except on matters of procedure and in cases where Article K.3 expressly provides for other voting rules.

Where the Council is required to act by a qualified majority, the votes of its members shall be weighted as laid down in Article 148(2) of the Treaty establishing the European Community, and for their adoption, acts of the Council shall require at least 62 votes in favour, cast by at least 10 members.

Qualora le deliberazioni del Consiglio richiedano la maggioranza qualificata, ai voti dei membri è attribuita la ponderazione prevista all'articolo 148, paragrafo 2, del trattato che istituisce la Comunità Europea e le deliberazioni sono valide se hanno ottenuto almeno 62 voti favorevoli, espressi da almeno 10 membri.

Article K.5  

Within international organizations and at international conferences in which they take part, Member States shall defend the common positions adopted under the provisions of this Title.

Nelle organizzazioni internazionali e in occasione delle conferenze internazionali cui partecipano, gli Stati membri esprimono le posizioni comuni adottate in applicazione delle disposizioni del presente titolo.

Article K.6  

The Presidency and the Commission shall regularly inform the European Parliament of discussions in the areas covered by this Title.

Articolo K.6

La presidenza e la Commissione informano regolarmente il Parlamento europeo dei lavori svolti nei settori che rientrano nel presente titolo.

The Presidency shall consult the European Parliament on the principal aspects of activities in the areas referred to in this Title and shall ensure that the views of the European Parliament are duly taken into consideration.

La presidenza consulta il Parlamento europeo sui principali aspetti dell'attività nei settori di cui al presente titolo e si adopera affinché le opinioni del Parlamento europeo siano tenute in debito conto.

The European Parliament may ask questions of the Council or make recommendations to it. Each year, it shall hold a debate on the progress made in implementation of the areas referred to in this Title.

Il Parlamento europeo può rivolgere al Consiglio interrogazioni o raccomandazioni. Esso procede ogni anno ad un dibattito sui progressi compiuti nell'attuazione delle disposizioni di cui al presente titolo.

Article K.7  

The provisions of this Title shall not prevent the establishment or development of closer cooperation between two or more Member States in so far as such cooperation does not conflict with, or impede, that provided for in this Title.

Articolo K.7

Le disposizioni del presente titolo non ostano all'instaurazione o allo sviluppo di una cooperazione più stretta tra due o più Stati membri, sempre che tale cooperazione non sia in contrasto con quella prevista nel presente titolo né la ostacoli.

Article K.8  

1. The provisions referred to in Articles 137, 138, 139 to 142, 146, 147, 150 to 153, 157 to 163 and 217 of the Treaty establishing the European Community shall apply to the provisions relating to the areas referred to in this Title.

2. Administrative expenditure which the provisions relating to the areas referred to in this Title entail for the institutions shall be charged to the budget of the European Communities.

The Council may also:

  • either decide unanimously that operational expenditure to which the implementation of those provisions gives rise is to be charged to the budget of the European Communities; in that event, the budgetary procedure laid down in the Treaty establishing the European Community shall be applicable;

Il Consiglio può altresì:

  • decidere all'unanimità che le spese operative dovute all'attuazione di dette disposizioni siano a carico del bilancio delle Comunità europee; in tal caso si applica la procedura di bilancio prevista dal trattato che istituisce la Comunità europea;
  • or determine that such expenditure shall be charged to the Member States, where appropriate in accordance with a scale to be decided.
  • o constatare che tali spese devono essere a carico degli Stati membri, eventualmente secondo un criterio di ripartizione da stabilirsi.

Article K.9  

The Council, acting unanimously on the initiative of the Commission or a Member State, may decide to apply Article 100c of the Treaty establishing the European Community to action in areas referred to in Article K.1(1) to (6), and at the same time determine the relevant voting conditions relating to it. It shall recommend the Member States to adopt that decision in accordance with their respective constitutional requirements.

Il Consiglio, deliberando all'unanimità su iniziativa della Commissione o di uno Stato membro, può decidere di rendere applicabile l'articolo 100c del trattato che istituisce la Comunità europea ad azioni pertinenti a settori contemplati dall'articolo K.1, punti da 1 a 6, decidendo nel contempo le relative condizioni di voto. Final provisions

 

Article L 

The provisions of the Treaty establishing the European Community, the Treaty establishing the European Coal and Steel Community and the Treaty establishing the European Atomic Energy Community concerning the powers of the Court of Justice of the European Communities and the exercise of those powers shall apply only to the following provisions of this Treaty:

 

  1. provisions amending the Treaty establishing the European Economic Community with a view to establishing the European Community, the Treaty establishing the European Coal and Steel Community and the Treaty establishing the European Atomic Energy Community;

Article M 

Subject to the provisions amending the Treaty establishing the European Economic Community with a view to establishing the European Community, the Treaty establishing the European Coal and Steel Community and the Treaty establishing the European Atomic Energy Community, and to these final provisions, nothing in this Treaty shall affect the Treaties establishing the European Communities or the subsequent Treaties and Acts modifying or supplementing them.

1. The government of any Member State or the Commission may submit to the Council proposals for the amendment of the Treaties on which the Union is founded.

1. Il governo di qualsiasi Stato membro o la Commissione possono sottoporre al Consiglio progetti intesi a modificare i trattati su cui è fondata l'Unione.

If the Council, after consulting the European Parliament and, where appropriate, the Commission, delivers an opinion in favour of calling a conference of representatives of the governments of the Member States, the conference shall be convened by the President of the Council for the purpose of determining by common accord the amendments to be made to those Treaties. The European Central Bank shall also be consulted in the case of institutional changes in the monetary area.

Qualora il Consiglio, dopo aver consultato il Parlamento europeo e, se del caso, la Commissione, esprima parere favorevole alla convocazione di una conferenza dei rappresentanti dei governi degli Stati membri, questa è convocata dal presidente del Consiglio allo scopo di stabilire di comune accordo le modifiche da apportare ai suddetti trattati. In caso di modifiche istituzionali nel settore monetario viene consultata anche la Banca centrale europea.

The amendments shall enter into force after being ratified by all the Member States in accordance with their respective constitutional requirements.

Gli emendamenti entreranno in vigore dopo essere stati ratificati da tutti gli Stati membri conformemente alle loro rispettive norme costituzionali.

2. A conference of representatives of the governments of the Member States shall be convened in 1996 to examine those provisions of this Treaty for which revision is provided, in accordance with the objectives set out in Articles A and B.

2. Una conferenza dei rappresentati dei governi degli Stati membri sarà convocata nel 1996 per esaminare, conformemente agli obiettivi stabiliti negli articoli A e B delle disposizioni comuni, le disposizioni del presente trattato per le quali è prevista una revisione.

Article O 

Any European State may apply to become a member of the Union. It shall address its application to the Council, which shall act unanimously after consulting the Commission and after receiving the assent of the European Parliament, which shall act by an absolute majority of its component members.

Articolo O 

Ogni Stato europeo può domandare di diventare membro dell'Unione. Esso trasmette la sua domanda al Consiglio che si pronuncia all'unanimità, previa consultazione della Commissione e previo parere conforme del Parlamento europeo, che si pronuncia a maggioranza assoluta dei membri che lo compongono.

The conditions of admission and the adjustments to the Treaties on which the Union is founded which such admission entails shall be the subject of an agreement between the Member States and the applicant State. This agreement shall be submitted for ratification by all the contracting States in accordance with their respective constitutional requirements.

Le condizioni per l'ammissione e gli adattamenti dei trattati su cui è fondata l'Unione, da essa determinati, formano l'oggetto di un accordo tra gli Stati membri e lo Stato richiedente. Tale accordo è sottoposto a ratifica da tutti gli Stati contraenti conformemente alle loro rispettive norme costituzionali.

Article P 

1. Articles 2 to 7 and 10 to 19 of the Treaty establishing a single Council and a single Commission of the European Communities, signed in Brussels on 8 April 1965, are hereby repealed.

1. Sono abrogati gli articoli da 2 a 7 e da 10 a 19 del trattato che istituisce un Consiglio unico e una Commissione unica delle Comunità europee, firmato a Bruxelles l'8 aprile 1965.

2. Article 2, Article 3(2) and Title III of the Single European Act signed in Luxembourg on 17 February 1986 and in The Hague on 28 February 1986 are hereby repealed.

This Treaty is concluded for an unlimited period.

1. This Treaty shall be ratified by the High Contracting Parties in accordance with their respective constitutional requirements. The instruments of ratification shall be deposited with the Government of the Italian Republic.

1. Il presente trattato sarà ratificato dalle Alte Parti Contraenti conformemente alle loro rispettive norme costituzionali. Gli strumenti di ratifica saranno depositati presso il governo della Repubblica italiana.

2. This Treaty shall enter into force on 1 January 1993, provided that all the instruments of ratification have been deposited, or, failing that, on the first day of the month following the deposit of the instrument of ratification by the last signatory State to take this step.

2. Il presente trattato entrerà in vigore il 1° gennaio 1993, se tutti gli strumenti di ratifica saranno stati depositati; altrimenti, il primo giorno del mese successivo all'avvenuto deposito dello strumento di ratifica da parte dello Stato firmatario che procederà per ultimo a tale formalità.

Article S 

This Treaty, drawn up in a single original in the Danish, Dutch, English, French, German, Greek, Irish, Italian, Portuguese and Spanish languages, the texts in each of these languages being equally authentic, shall be deposited in the archives of the government of the Italian Republic, which will transmit a certified copy to each of the governments of the other signatory States.

Having considered the terms of Protocol No 17 to the said Treaty on European Union which is annexed to that Treaty and to the Treaties establishing the European Communities,

Hereby give the following legal interpretation:

That it was and is their intention that the Protocol shall not limit freedom to travel between Member States or, in accordance with conditions which may be laid down, in conformity with Community law, by Irish legislation, to obtain or make available in Ireland information relating to services lawfully available in Member States.

At the same time the High Contracting Parties solemnly declare that, in the event of a future constitutional amendment in Ireland which concerns the subject matter of Article 40.3.3 of the Constitution of Ireland and which does not conflict with the intention of the High Contracting Parties hereinbefore expressed, they will, following the entry into force of the Treaty on European Union, be favourably disposed to amending the said Protocol so as to extend its application to such constitutional amendment if Ireland so requests.

TITLE I

Common provisions

 

Article A 

By this Treaty, the HIGH CONTRACTING PARTIES establish among themselves a EUROPEAN UNION, hereinafter called 'the Union'.

This Treaty marks a new stage in the process of creating an ever closer union among the peoples of Europe, in which decisions are taken as closely as possible to the citizen.

The Union shall be founded on the European Communities, supplemented by the policies and forms of cooperation established by this Treaty. Its task shall be to organize, in a manner demonstrating consistency and solidarity, relations between the Member States and between their peoples.

Article B 

The Union shall set itself the following objectives:

  • to promote economic and social progress which is balanced and sustainable, in particular through the creation of an area without internal frontiers, through the strengthening of economic and social cohesion and through the establishment of economic and monetary union, ultimately including a single currency in accordance with the provisions of this Treaty;
  • to assert its identity on the international scene, in particular through the implementation of a common foreign and security policy including the eventual framing of a common defence policy, which might in time lead to a common defence;
  • to strengthen the protection of the rights and interests of the nationals of its Member States through the introduction of a citizenship of the Union;
  • to develop close cooperation on justice and home affairs;
  • to maintain in full the acquis communautaire and build on it with a view to considering, through the procedure referred to in Article N(2), to what extent the policies and forms of cooperation introduced by this Treaty may need to be revised with the aim of ensuring the effectiveness of the mechanisms and the institutions of the Community.

The objectives of the Union shall be achieved as provided in this Treaty and in accordance with the conditions and the timetable set out therein while respecting the principle of subsidiarity as defined in Article 3b of the Treaty establishing the European Community.

Article C 

The Union shall be served by a single institutional framework which shall ensure the consistency and the continuity of the activities carried out in order to attain its objectives while respecting and building upon the acquis communautaire.

The Union shall in particular ensure the consistency of its external activities as a whole in the context of its external relations, security, economic and development policies. The Council and the Commission shall be responsible for ensuring such consistency. They shall ensure the implementation of these policies, each in accordance with its respective powers.

Article D 

The European Council shall provide the Union with the necessary impetus for its development and shall define the general political guidelines thereof.

The European Council shall bring together the Heads of State or Government of the Member States and the President of the Commission. They shall be assisted by the Ministers for Foreign Affairs of the Member States and by a Member of the Commission. The European Council shall meet at least twice a year, under the chairmanship of the Head of State or Government of the Member State which holds the Presidency of the Council.

The European Council shall submit to the European Parliament a report after each of its meetings and a yearly written report on the progress achieved by the Union.

Article E 

The European Parliament, the Council, the Commission and the Court of Justice shall exercise their powers under the conditions and for the purposes provided for, on the one hand, by the provisions of the Treaties establishing the European Communities and of the subsequent Treaties and Acts modifying and supplementing them and, on the other hand, by the other provisions of this Treaty.

Article F 

1. The Union shall respect the national identities of its Member States, whose systems of government are founded on the principles of democracy.

2. The Union shall respect fundamental rights,as guaranteed by the European Convention for the Protection of Human Rights and Fundamental Freedoms signed in Rome on 4 November 1950 and as they result from the constitutional traditions common to the Member States, as general principles of Community law.

3. The Union shall provide itself with the means necessary to attain its objectives and carry through its policies

 

TITLE V

Provisions on a common foreign and security policy

Article J

A common foreign and security policy is hereby established which shall be governed by the following provisions.

Article J.1  

1. The Union and its Member States shall define and implement a common foreign and security policy, governed by the provisions of this Title and covering all areas of foreign and security policy.

2. The objectives of the common foreign and security policy shall be:

  • to safeguard the common values, fundamental interests and independence of the Union;
  • to strengthen the security of the Union and its Member States in all ways;
  • to preserve peace and strengthen international security, in accordance with the principles of the United Nations Charter as well as the principles of the Helsinki Final Act and the objectives of the Paris Charter;
  • to promote international cooperation;
  • to develop and consolidate democracy and the rule of law, and respect for human rights and fundamental freedoms.

3. The Union shall pursue these objectives:

  • by establishing systematic cooperation between Member States in the conduct of policy, in accordance with Article J.2;
     
  • by gradually implementing, in accordance with Article J.3, joint action in the areas in which the Member States have important interests in common.

4. The Member States shall support the Union's external and security policy actively and unreservedly in a spirit of loyalty and mutual solidarity. They shall refrain from any action which is contrary to the interests of the Union or likely to impair its effectiveness as a cohesive force in international relations. The Council shall ensure that these principles are complied with.

Article J.2  

1. Member States shall inform and consult one another within the Council on any matter of foreign and security policy of general interest in order to ensure that their combined influence is exerted as effectively as possible by means of concerted and convergent action.

2. Whenever it deems it necessary, the Council shall define a common position.


Member States shall ensure that their national policies conform to the common positions.

3. Member States shall coordinate their action in international organizations and at international conferences. They shall uphold the common positions in such forums.

In international organizations and at international conferences where not all the Member States participate, those which do take part shall uphold the common positions.

Article J.3  

The procedure for adopting joint action in matters covered by the foreign and security policy shall be the following:

  1. The Council shall decide, on the basis of general guidelines from the European Council, that a matter should be the subject of joint action.

Whenever the Council decides on the principle of joint action, it shall lay down the specific scope, the Union's general and specific objectives in carrying out such action, if necessary its duration, and the means, procedures and conditions for its implementation.

  1. The Council shall, when adopting the joint action and at any stage during its development, define those matters on which decisions are to be taken by a qualified majority.

Where the Council is required to act by a qualified majority pursuant to the preceding subparagraph, the votes of its members shall be weighted in accordance with Article 148(2) of the Treaty establishing the European Community, and for their adoption, acts of the Council shall require at least 62 votes in favour, cast by at least 10 members.

  1. If there is a change in circumstances having a substantial effect on a question subject to joint action, the Council shall review the principles and objectives of that action and take the necessary decisions. As long as the Council has not acted, the joint action shall stand.
  1. Joint actions shall commit the Member States in the positions they adopt and in the conduct of their activity.
  1. Whenever there is any plan to adopt a national position or take national action pursuant to a joint action, information shall be provided in time to allow, if necessary, for prior consultations within the Council. The obligation to provide prior information shall not apply to measures which are merely a national transposition of Council decisions.
  1. In cases of imperative need arising from changes in the situation and failing a Council decision, Member States may take the necessary measures as a matter of urgency having regard to the general objectives of the joint action. The Member State concerned shall inform the Council immediately of any such measures.
  1. Should there be any major difficulties in implementing a joint action, a Member State shall refer them to the Council which shall discuss them and seek appropriate solutions. Such solutions shall not run counter to the objectives of the joint action or impair its effectiveness.

Article J.4  

1. The common foreign and security policy shall include all questions related to the security of the Union, including the eventual framing of a common defence policy, which might in time lead to a common defence.

2. The Union requests the Western European Union (WEU), which is an integral part of the development of the Union, to elaborate and implement decisions and actions of the Union which have defence implications. The Council shall, in agreement with the institutions of the WEU, adopt the necessary practical arrangements.

3. Issues having defence implications dealt with under this Article shall not be subject to the procedures set out in Article J.3.

4. The policy of the Union in accordance with this Article shall not prejudice the specific character of the security and defence policy of certain Member States and shall respect the obligations of certain Member States under the North Atlantic Treaty and be compatible with the common security and defence policy established within that framework.

5. The provisions of this Article shall not prevent the development of closer cooperation between two or more Member States on a bilateral level,in the framework of the WEU and the Atlantic Alliance, provided such cooperation does not run counter to or impede that provided for in this Title.

6. With a view to furthering the objective of this Treaty, and having in view the date of 1998 in the context of Article XII of the Brussels Treaty, the provisions of this Article may be revised as provided for in Article N(2) on the basis of a report to be presented in 1996 by the Council to the European Council, which shall include an evaluation of the progress made and the experience gained until then.

Article J.5  

1. The Presidency shall represent the Union in matters coming within the common foreign and security policy.

2. The Presidency shall be responsible for the implementation of common measures; in that capacity it shall in principle express the position of the Union in international organizations and international conferences.

3. In the tasks referred to in paragraphs 1 and 2, the Presidency shall be assisted if need be by the previous and next Member States to hold the Presidency. The Commission shall be fully associated in these tasks.

4. Without prejudice to Article J.2(3) and Article J.3(4), Member States represented in international organizations or international conferences where not all the Member States participate shall keep the latter informed of any matter of common interest.

Member States which are also members of the United Nations Security Council will concert and keep the other Member States fully informed. Member States which are permanent members of the Security Council will, in the execution of their functions, ensure the defence of the positions and the interests of the Union, without prejudice to their responsibilities under the provisions of the United Nations Charter.

Article J.6  

The diplomatic and consular missions of the Member States and the Commission Delegations in third countries and international conferences, and their representations to international organizations, shall cooperate in ensuring that the common positions and common measures adopted by the Council are complied with and implemented.

They shall step up cooperation by exchanging information, carrying out joint assessments and contributing to the implementation of the provisions referred to in Article 8c of the Treaty establishing the European Community.

Article J.7  

The Presidency shall consult the European Parliament on the main aspects and the basic choices of the common foreign and security policy and shall ensure that the views of the European Parliament are duly taken into consideration. The European Parliament shall be kept regularly informed by the Presidency and the Commission of the development of the Union's foreign and security policy.

The European Parliament may ask questions of the Council or make recommendations to it. It shall hold an annual debate on progress in implementing the common foreign and security policy.

Article J.8  

1. The European Council shall define the principles of and general guidelines for the common foreign and security policy.

2. The Council shall take the decisions necessary for defining and implementing the common foreign and security policy on the basis of the general guidelines adopted by the European Council. It shall ensure the unity, consistency and effectiveness of action by the Union.

The Council shall act unanimously, except for procedural questions and in the case referred to in Article J.3(2).

3. Any Member State or the Commission may refer to the Council any question relating to the common foreign and security policy and may submit proposals to the Council.

4. In cases requiring a rapid decision, the Presidency, of its own motion, or at the request of the Commission or a Member State, shall convene an extraordinary Council meeting within 48 hours or, in an emergency, within a shorter period.

5. Without prejudice to Article 151 of the Treaty establishing the European Community, a Political Committee consisting of Political Directors shall monitor the international situation in the areas covered by common foreign and security policy and contribute to the definition of policies by delivering opinions to the Council at the request of the Council or on its own initiative. It shall also monitor the implementation of agreed policies, without prejudice to the responsibility of the Presidency and the Commission.

Article J.9  

The Commission shall be fully associated with the work carried out in the common foreign and security policy field.

Article J.10  

On the occasion of any review of the security provisions under Article J.4,the Conference which is convened to that effect shall also examine whether any other amendments need to be made to provisions relating to the common foreign and security policy.

Article J.11  

1. The provisions referred to in Articles 137, 138, 139 to 142, 146, 147, 150 to 153, 157 to 163 and 217 of the Treaty establishing the European Community shall apply to the provisions relating to the areas referred to in this Title.

2. Administrative expenditure which the provisions relating to the areas referred to in this Title entail for the institutions shall be charged to the budget of the European Communities.

The Council may also:

  • either decide unanimously that operational expenditure to which the implementation of those provisions gives rise is to be charged to the budget of the European Communities; in that event, the budgetary procedure laid down in the Treaty establishing the European Community shall be applicable;
  • or determine that such expenditure shall be charged to the Member States, where appropriate in accordance with a scale to be decided.

TITLE VI

Provisions on cooperation in the fields of justice and home affairs


Article K

Cooperation in the fields of justice and home affairs shall be governed by the following provisions.

Article K.1  

For the purposes of achieving the objectives of the Union, in particular the free movement of persons,and without prejudice to the powers of the European Community, Member States shall regard the following areas as matters of common interest:

  1. asylum policy;

  1. rules governing the crossing by persons of the external borders of the Member States and the exercise of controls thereon;

  1. immigration policy and policy regarding nationals of third countries:

    1. conditions of entry and movement by nationals of third countries on the territory of Member States;

    2. conditions of residence by nationals of third countries on the territory of Member States, including family reunion and access to employment;
       

    3. combating unauthorized immigration, residence and work by nationals of third countries on the territory of Member States;

  1. combating drug addiction in so far as this is not covered by (7) to (9);

  1. combating fraud on an international scale in so far as this is not covered by (7) to (9);

  1. judicial cooperation in civil matters;

  1. judicial cooperation in criminal matters;

  1. customs cooperation;

  1. police cooperation for the purposes of preventing and combating terrorism, unlawful drug-trafficking and other serious forms of international crime, including if necessary certain aspects of customs cooperation, in connection with the organization of a Union-wide system for exchanging information within a European Police Office (Europol).

Article K.2  

1. The matters referred to in Article K.1 shall be dealt with in compliance with the European Convention for the Protection of Human Rights and Fundamental Freedoms of 4 November 1950 and the Convention relating to the Status of Refugees of 28 July 1951 and having regard to the protection afforded by Member States to persons persecuted on political grounds.

2. This Title shall not affect the exercise of the responsibilities incumbent upon Member States with regard to the maintenance of law and order and the safeguarding of internal security.

Article K.3  

1. In the areas referred to in Article K.1, Member States shall inform and consult one another within the Council with a view to coordinating their action. To that end, they shall establish collaboration between the relevant departments of their administrations.

2. The Council may:

  • on the initiative of any Member State or of the Commission, in the areas referred to in Article K.1(1) to (6);

  • on the initiative of any Member State, in the areas referred to in Article K.1(7) to (9):

    1. adopt joint positions and promote, using the appropriate form and procedures, any cooperation contributing to the pursuit of the objectives of the Union;

    2. adopt joint action in so far as the objectives of the Union can be attained better by joint action than by the Member States acting individually on account of the scale or effects of the action envisaged; it may decide that measures implementing joint action are to be adopted by a qualified majority;

       

    3. without prejudice to Article 220 of the Treaty establishing the European Community, draw up conventions which it shall recommend to the Member States for adoption in accordance with their respective constitutional requirements.

Unless otherwise provided by such conventions, measures implementing them shall be adopted wihtin the Council by a majority of two thirds of the High Contracting Parties.

Such conventions may stipulate that the Court of Justice shall have jurisdiction to interpret their provisions and to rule on any disputes regarding their application, in accordance with such arrangements as they may lay down.

Article K.4  

1. A Coordinating Committee shall be set up consisting of senior officials. In addition to its coordinating role, it shall be the task of the Committee to:

  • give opinions for the attention of the Council, either at the Council's request or on its own initiative;

  • contribute, without prejudice to Article 151 of the Treaty establishing the European Community, to the preparation of the Council's discussions in the areas referred to in Article K.1 and, in accordance with the conditions laid down in Article 100d of the Treaty establishing the European Community, in the areas referred to in Article 100c of that Treaty.

2. The Commission shall be fully associated with the work in the areas referred to in this Title.

3. The Council shall act unanimously, except on matters of procedure and in cases where Article K.3 expressly provides for other voting rules.

Where the Council is required to act by a qualified majority, the votes of its members shall be weighted as laid down in Article 148(2) of the Treaty establishing the European Community, and for their adoption, acts of the Council shall require at least 62 votes in favour, cast by at least 10 members.

Article K.5  

Within international organizations and at international conferences in which they take part, Member States shall defend the common positions adopted under the provisions of this Title.

Article K.6  

The Presidency and the Commission shall regularly inform the European Parliament of discussions in the areas covered by this Title.

The Presidency shall consult the European Parliament on the principal aspects of activities in the areas referred to in this Title and shall ensure that the views of the European Parliament are duly taken into consideration.

The European Parliament may ask questions of the Council or make recommendations to it. Each year, it shall hold a debate on the progress made in implementation of the areas referred to in this Title.

Article K.7  

The provisions of this Title shall not prevent the establishment or development of closer cooperation between two or more Member States in so far as such cooperation does not conflict with, or impede, that provided for in this Title.

Article K.8  

1. The provisions referred to in Articles 137, 138, 139 to 142, 146, 147, 150 to 153, 157 to 163 and 217 of the Treaty establishing the European Community shall apply to the provisions relating to the areas referred to in this Title.

2. Administrative expenditure which the provisions relating to the areas referred to in this Title entail for the institutions shall be charged to the budget of the European Communities.

The Council may also:

  • either decide unanimously that operational expenditure to which the implementation of those provisions gives rise is to be charged to the budget of the European Communities; in that event, the budgetary procedure laid down in the Treaty establishing the European Community shall be applicable;

  • or determine that such expenditure shall be charged to the Member States, where appropriate in accordance with a scale to be decided.

Article K.9  

The Council, acting unanimously on the initiative of the Commission or a Member State, may decide to apply Article 100c of the Treaty establishing the European Community to action in areas referred to in Article K.1(1) to (6), and at the same time determine the relevant voting conditions relating to it. It shall recommend the Member States to adopt that decision in accordance with their respective constitutional requirements.

TITLE VII

Final provisions

 

Article L 

The provisions of the Treaty establishing the European Community, the Treaty establishing the European Coal and Steel Community and the Treaty establishing the European Atomic Energy Community concerning the powers of the Court of Justice of the European Communities and the exercise of those powers shall apply only to the following provisions of this Treaty:

 

  1. provisions amending the Treaty establishing the European Economic Community with a view to establishing the European Community, the Treaty establishing the European Coal and Steel Community and the Treaty establishing the European Atomic Energy Community;
  1. the third subparagraph of Article K.3(2)(c);
  1. Articles L to S.

Article M 

Subject to the provisions amending the Treaty establishing the European Economic Community with a view to establishing the European Community, the Treaty establishing the European Coal and Steel Community and the Treaty establishing the European Atomic Energy Community, and to these final provisions, nothing in this Treaty shall affect the Treaties establishing the European Communities or the subsequent Treaties and Acts modifying or supplementing them.

Article N 

1. The government of any Member State or the Commission may submit to the Council proposals for the amendment of the Treaties on which the Union is founded.

If the Council, after consulting the European Parliament and, where appropriate, the Commission, delivers an opinion in favour of calling a conference of representatives of the governments of the Member States, the conference shall be convened by the President of the Council for the purpose of determining by common accord the amendments to be made to those Treaties. The European Central Bank shall also be consulted in the case of institutional changes in the monetary area.

The amendments shall enter into force after being ratified by all the Member States in accordance with their respective constitutional requirements.

2. A conference of representatives of the governments of the Member States shall be convened in 1996 to examine those provisions of this Treaty for which revision is provided, in accordance with the objectives set out in Articles A and B.

Article O 

Any European State may apply to become a member of the Union. It shall address its application to the Council, which shall act unanimously after consulting the Commission and after receiving the assent of the European Parliament, which shall act by an absolute majority of its component members.

The conditions of admission and the adjustments to the Treaties on which the Union is founded which such admission entails shall be the subject of an agreement between the Member States and the applicant State. This agreement shall be submitted for ratification by all the contracting States in accordance with their respective constitutional requirements.

Article P 

1. Articles 2 to 7 and 10 to 19 of the Treaty establishing a single Council and a single Commission of the European Communities, signed in Brussels on 8 April 1965, are hereby repealed.

2. Article 2, Article 3(2) and Title III of the Single European Act signed in Luxembourg on 17 February 1986 and in The Hague on 28 February 1986 are hereby repealed.

Article Q 

This Treaty is concluded for an unlimited period.

Article R 

1. This Treaty shall be ratified by the High Contracting Parties in accordance with their respective constitutional requirements. The instruments of ratification shall be deposited with the Government of the Italian Republic.

2. This Treaty shall enter into force on 1 January 1993, provided that all the instruments of ratification have been deposited, or, failing that, on the first day of the month following the deposit of the instrument of ratification by the last signatory State to take this step.

Article S 

This Treaty, drawn up in a single original in the Danish, Dutch, English, French, German, Greek, Irish, Italian, Portuguese and Spanish languages, the texts in each of these languages being equally authentic, shall be deposited in the archives of the government of the Italian Republic, which will transmit a certified copy to each of the governments of the other signatory States.

Protocol (No 17)
annexed to the Treaty on European Union and to the Treaties establishing the European Communities

THE HIGH CONTRACTING PARTIES

HAVE AGREED upon the following provision, which shall be annexed to the Treaty on European Union and to the Treaties establishing the European Communities:

Nothing in the Treaty on European Union, or in the Treaties establishing the European Communities, or in the Treaties or Acts modifying or supplementing those Treaties, shall affect the application in Ireland of Article 40.3.3 of the Constitution of Ireland.

Declaration of 1 May 1992

On 1 May 1992, in Guimarães (Portugal), the High Contracting Parties to the Treaty on European Union adopted the following Declaration:

DECLARATION OF THE HIGH CONTRACTING PARTIES TO THE TREATY ON EUROPEAN UNION

The High Contracting Parties to the Treaty on European Union signed at Maastricht on the seventh day of February 1992,

Having considered the terms of Protocol No 17 to the said Treaty on European Union which is annexed to that Treaty and to the Treaties establishing the European Communities,

Hereby give the following legal interpretation:

That it was and is their intention that the Protocol shall not limit freedom to travel between Member States or, in accordance with conditions which may be laid down, in conformity with Community law, by Irish legislation, to obtain or make available in Ireland information relating to services lawfully available in Member States.

At the same time the High Contracting Parties solemnly declare that, in the event of a future constitutional amendment in Ireland which concerns the subject matter of Article 40.3.3 of the Constitution of Ireland and which does not conflict with the intention of the High Contracting Parties hereinbefore expressed, they will, following the entry into force of the Treaty on European Union, be favourably disposed to amending the said Protocol so as to extend its application to such constitutional amendment if Ireland so requests.
