EUROPEAN COURT OF JUSTICE AND EUROPEAN COURT OF FIRST INSTANCE

Community law is directly applicable in the courts of all the EU Member States.

In this context, the role of the Court of Justice together with the Court of First Instance is to provide the judicial safeguards of the Community legal system.

The core mission is to ensure that EU law is observed and upheld in the interpretation and application of both the Treaties and all Community activities.

The Court of First Instance was established in 1989 to ease the increasing workload of the Court of Justice.

The objective was not only to strengthen the protection of individuals' interests by introducing a second tier of judicial authority but also to take some of the workload from the Court of Justice, enabling this institution to concentrate on its fundamental task.

Function and responsibilities of the Court of Justice

The Court of Justice as a judicial institution and EU control body has had a major influence on the development of Community law and has been given a number of tasks and authorities exceeding its customary juridical function.

The composition of the Court of Justice reflects its core objective: to strengthen the judicial protection of individuals and to ensure the uniform interpretation of Community law.

Responsibilities and powers in:

opinions on international agreements.

Various forms of action include:

proceedings for failure to fulfil an obligation;

proceedings for annulment;

proceedings for failure to act;

actions for damages;

appeals;

preliminary rulings.

Preliminary rulings are of vital importance for the uniform interpretation of Community law.

They are given when national courts refer disputes pending before them to the Court of Justice, ensuring permanent cooperation between the Court of Justice and the national courts.

The Court also issues rulings on breaches of Community law by the Member States.

Procedures of the Court of Justice are laid down in the Treaties.

Following a principle that the Community Treaties must be viewed in the light of the state of integration and Treaty objectives rather than rigidly interpreted, the Community can also legislate in areas where no specific Treaty provisions exist.

As a result of the Amsterdam Treaty, the Court has been given more power in cases of infringement of Community law as a result of action by the institutions.

Part of the cooperation in the field of justice and home affairs is now also subject to the limited jurisdiction of the Court.

Regarding procedures of the Court of Justice, a distinction must be drawn between direct actions and requests for preliminary rulings.

Function and responsibilities of the Court of First Instance

The Court of First Instance exercises the jurisdiction conferred on the Court of Justice in the following areas:

disputes between the Communities and its officials and other staff;

actions brought against the Commission by undertakings or associations of undertakings;

actions brought against a Community institution by natural or legal persons.

The powers of the Court for First Instance regarding the implementation of competition rules applicable to undertakings are restricted.

Composition and types of proceeding reflect the role of the Court of First Instance as an autonomous body.

Following a 1993 Council decision, the powers of the Court of First Instance were extended to all cases brought by private individuals and companies against decisions of the Community institutions and agencies.

This includes actions for declaration of failure to act, for annulment and for damages.

It principally concerns actions brought by individuals for declarations of failure to act in cases of State aid and trade protection (anti-dumping and anti-subsidy) measures.

Appeals may be made to the Court of First Instance only on points of law and not on points of fact.

The procedures of the Court of First Instance comprise two stages, written and oral, and are governed, essentially, by principles similar to those governing direct actions before the Court of Justice.
