The Council - also referred to as the Council of Ministers - is the European Union's main decision-making institution and final legislative authority.

The Council of the European Union, as an EU institution, should not be confused with the European Council - which brings together the Heads of State or Government of the Member States of the European Union and the President of the European Commission - or with the Council of Europe which is an international organisation.

Under the Treaty establishing the European Community, the main responsibilities of the Council are the following:

the Council is the Community's legislative body; for a wide range of Community issues, it exercises that legislative power in co-decision with the European Parliament;

Under the Treaty on European Union, the Council also:

takes the decisions necessary for defining and implementing the common foreign and security policy on the basis of general guidelines established by the European Council;

The Council is a body with the characteristics of both a supranational and an intergovernmental organisation. This is reflected by the composition and Presidency of the Council, as well as the working procedures associated with the Council's activities.

The role of the Council in the decision-making and legislative process

The role of the Council as the main decision-making institution in Community activities is defined in terms of the three 'pillars' set out in the Treaty on European Union (the Treaty of Maastricht).

The first pillar - covering a wide range of Community policies such as agriculture, transport, environment, energy, research and development - is designed and implemented according to a well-proven decision-making process which starts with a Commission proposal.

Following detailed examination by experts and at the political level, the Council may either adopt the Commission proposal, amend it or ignore it.

The Treaty of Maastricht strengthened the role of the European Parliament in this context by creating a co-decision procedure.

As a consequence, a wide range of legislation (such as that pertaining to the single market, consumer affairs, trans-European networks, education and health) is adopted by both the Parliament and the Council.

The Treaties lay down that, depending on the subject, the Council acts by a simple majority of its members, by a qualified majority or by unanimous decision.

Where the Council acts by a qualified majority, the votes of each of its members are weighted.

In the Community sphere, a large proportion of legislative decisions are taken by qualified majority.

The policy areas in the first pillar which remain subject to unanimity include taxation, industry, culture, regional and social funds and the framework programme for research and technology development.

For the other two pillars created by the Treaty on European Union, the Council is the decision-maker as well as the promoter of initiatives.

On common foreign and security policy the Council takes the decisions necessary for defining and implementing this policy, on the basis of general guidelines specified by the European Council.

It recommends common strategies to the European Council and implements them, particularly by deciding on joint actions and common positions.

On police and judicial cooperation in criminal matters, the Council, at the initiative of a Member State or of the Commission, decides on common positions, framework decisions and decisions, and draws up conventions.

The Council may also adopt conclusions of a political nature or other types of acts such as Declarations or Resolutions.

Furthermore, the Council establishes requirements for exercising the implementing powers conferred on the Commission or reserved to the Council itself.

The European Commission, a political body, has various responsibilities and plays a major role in the European Union's policy-making process as EU laws are mainly enforced by Commission action.

The Single European Act of 1986 as well as the Treaty on European Union and the Amsterdam Treaty confirmed and expanded the scope of the Union and the Commission's responsibility in additional areas.

L'Atto unico europeo del 1986, nonchè il trattato sull'Unione europea ed il trattato di Amsterdam hanno confermato ed esteso lo scopo dell'Unione e le responsabilità della Commissione in più settori.

These include the environment, education, health, consumer affairs, the trans-European networks, R&D policy, culture, and economic and monetary union (EMU).

In 1995 the composition of the Commission was adapted to account for the accession of Finland, Sweden and Austria.

Commission proposals, actions and decisions are in various ways scrutinised, checked and judged by the other institutions (except the European Investment Bank).

The European Commission has three distinct functions:

The Commission has a monopoly on the initiative in Community decision-making and drafts proposals for a decision by the two decision-making institutions: the Parliament and the Council.

Thus, the legislative process begins with Commission proposals (for regulations or directives) which need to be in line with the Treaties and help to implement them.

Normally, the Commission takes guidelines of national authorities into account. Commission proposals must encompass three core objectives:

Once the Commission has formally sent a proposal for legislation to the Council and the Parliament, the Union's law-making process is dependent on effective cooperation between three institutions - the Council, the Commission and the European Parliament.

The European Parliament shares the power of co-decision with the Council in most areas and has to be consulted in others.

When revising its proposals, the Commission is required to take amendments of the Parliament into consideration.

The Commission does not have an exclusive right of initiative in the two areas of intergovernmental cooperation covered by the Treaty on European Union: common foreign and security policy and cooperation on justice and home affairs. But it may submit a proposal and participates in discussions at all levels.

A major responsibility of the Commission is to ensure that EU law is applied properly by the Member States.

If it is considered that a Member State does not fulfil its obligations under the Treaty, the Commission, mainly through the 'failure to act' procedure, can initiate proceedings by requiring the State concerned to submit its observations.

If these do not satisfy the Commission, a reasoned opinion is delivered, requiring the matter to be sorted out by a specific date. After that Commission action in this respect may also include legal proceedings before the Court of Justice.

The role of the European Commission in the legislative process

Given its central position in the structure of the European Union, the Commission has special links with each of the other institutions.

The Commission's management of the EU budget is scrutinised by the Court of Auditors which is responsible for examining the legality and regularity of revenue and expenditure and for ensuring the sound financial management of the EU budget.

The common goal of both institutions is to eliminate fraud and wastage. On the basis of the Court of Auditors' reports, it is the European Parliament which gives the Commission final discharge for the execution of the annual budget.
